Terms & Condition

Here is what you should keep in mind

The Rental Agreement is made between the lessor and the Lessee (client) whereas:

The Rental Agreement is made between the lessor and the Lessee (client) whereas: The Lessor shall at all times retain the ownership of the motor Vehicles and the Lessee shall have no interest in the Motor vehicles save as is provided by this Agreement.

Insurance & Licenses

Lessor’s Covenants:

To insure the Motor Vehicles throughout the Lease Term for their full replacement value against all risks on a comprehensive policy without restriction.
To acquire the road license and insurance disc cover for the Motor Vehicles.
To ensure that the Motor Vehicle has valid road license and insurance cover disc displayed.
To ensure compliance with any statutory changes in respect of the Motor Vehicles as may be effected from time to time.

Lessee Covenant:

To deliver up the Motor Vehicles from time to time in order that maintenance and servicing may be carried out to the Motor Vehicles in accordance with the recommendations of the manufacturer or supplier of the Motor Vehicles.
To make no alteration to the Motor Vehicles and not to remove any existing component from the Motor Vehicles.
To notify the Lessor of any breakdown of the Motor Vehicles and not attempt to repair of punctures and other minor repairs.
Not to use the Motor Vehicles or permit the same to be used for reliability trail, speed testing, racing or record attempting or any competition whatsoever.
To obtain prior consent of the Lessor if the Motor Vehicle is taken across the borders of Tanzania, upon which the Lessor will provide the necessary insurance cover which will be billed to the Lessee at cost.

Rates & Payment Terms

The rental charges for the hire of the motor vehicle or its replacement will be paid in advance for self drive hire while for a long term hire all the payment will be paid within the period of 30 days from the date of Invoice at the rate agreed upon signing of this contract.
Number of days involved in the total price is subject to day of hire and day of return of the vehicle
Should costs outside the Lessor increase substantially to affect the price, the Lessor will inform the Lessee (Client) in advance before adopting the new price.
For long term contracts, all unpaid invoices will attract 10% interest charge per month

Delivery

The Owner will ensure before handing over possession and control of the motor vehicle to the Hirer that the same is in a fit and roadworthy condition for the intended use. Damages to the vehicle or loss of vehicle accessories will be gaged at the end of hire period, costs of which will be paid in full by the Lessee (Client).

Maintenance

Lessor’s Covenants:

To provide comprehensive maintenance services in respect of the Motor Vehicles, including regular servicing.
To keep or procure to be kept throughout the Term accurate and current records of all maintenance carried out on the Motor Vehicles.
To give the Lessee at least seven (7) days notice of scheduled regular maintenance; to agree with the Lessor the precise dates and times for collection of the vehicle for such regular maintenance; and to return the vehicle within twenty four (24) hours of collection.
To ensure that any maintenance is carried out on the Motor Vehicles in the shortest time possible provided that any period during which the Motor Vehicles are under service or repair shall constitute an integral part of the Term.
In the event that a vehicle is involved in an accident or requires unscheduled maintenance, the Lessor shall use its best endeavors to assist the Lessee in getting an equivalent replacement vehicle at the agreed Rental rates.

Termination

This Agreement shall run for the duration of the Lease Term in respect of each Motor Vehicle unless terminated in accordance with this clause.
This Agreement and shall be terminable at any time without cause on one (1) month’s notice in writing by either party.

Governing Law

The Agreement shall be governed and construed according to the Law of Tanzania.
